Medical Waiver & Assumption of Risk

This waiver is entered into between Given2Fly, obrt za usluge i turistička agencija, vl. Mariana Andrijašević (trading as “Given2Fly Adventures”, “Provider”) and the participant in any rental or guided activity (the “Participant”).

1. Health Declaration

By signing this waiver, the Participant declares that they are in good physical health and have no medical conditions that would prevent them from safely riding a bicycle or participating in a guided cycling tour. If the Participant has any pre-existing medical condition (including but not limited to heart conditions, epilepsy, respiratory disorders, or musculoskeletal injuries), they must disclose this to Given2Fly Adventures staff before the activity begins.

2. Assumption of Risk

The Participant acknowledges that cycling and related outdoor activities carry inherent risks, including but not limited to:

• Falls, collisions, and contact with other riders, vehicles, pedestrians, or fixed objects.
• Injuries resulting from road surface conditions, weather, or terrain.
• Mechanical failure of the bicycle or accessories.
• Exposure to sun, heat, dehydration, or other weather-related conditions.
• Encounters with traffic, animals, or uneven terrain.

The Participant voluntarily assumes all such risks and agrees to participate at their own discretion and responsibility.

3. Waiver of Liability

To the fullest extent permitted by the laws of the Republic of Croatia, the Participant waives any and all claims against Given2Fly Adventures, its owners, employees, guides, and agents for injury, illness, death, or property damage arising from participation in the activity, except where caused by the gross negligence or wilful misconduct of the Provider.

4. Medical Treatment Authorisation

In the event of an injury or medical emergency during the activity, the Participant authorises Given2Fly Adventures staff and guides to arrange emergency medical treatment, including ambulance transport, on the Participant’s behalf. The Participant agrees to bear all costs of such medical treatment.

5. Emergency Contact

The Participant must provide an emergency contact name and phone number at the time of booking or check-in. This information will be used only in the event of a medical emergency.

6. Fitness to Ride

Given2Fly Adventures reserves the right to refuse participation to any individual who, in the reasonable judgement of the guide, appears unfit to ride safely – whether due to intoxication, physical condition, or behaviour. In such cases, no refund will be provided.

7. Minors

Participants under the age of 18 must have this waiver signed by a parent or legal guardian. The parent or guardian assumes all risks and liabilities on behalf of the minor.

8. Acknowledgement

By proceeding with the rental or tour, the Participant confirms that they have read, understood, and voluntarily agreed to this Medical Waiver and Assumption of Risk.
